GMB Wins £8,988.20 Compensation For Leeds Resident Who Was Unfairly Dismissed By Whitecase LTD

GMB member Boguslaw Szulgan has been awarded £8988.20 in compensation by the Leeds employment tribunal yesterday which found that he had been unfairly dismissed by his employer Whitecase Recycling, Stourton, Leeds, simply for being a GMB member.
The dispute arose when management at Whitecase Ltd in Leeds wanted to change the method of paying wages which would result in workers having to work a week in hand without pay. Mr Szulgan contacted GMB and with the unions support submit a grievance to the company. Unfortunately the company directors met with Mr Szulgan without his GMB officer present and subjected him to bullying and intimidation because of his GMB membership.
Mr Szulgan was dismissed without notice and was owed wages and holiday pay. He appealed the decision but the company failed to arrange a hearing date.
GMB won Mr Szulgan’s case and £8988.20 in compensation for the unfair treatment he received.
Mr Szulgan, GMB member said, “My English is quite limited but I could make out the repeated swearing. I was aware that two other employees who had submitted grievances had been sacked the day before. Throughout the meeting I maintained my right to be in GMB and call on its services.”
Bill Innes, GMB Legal Officer said, “GMB’s claim was made on behalf of Mr Szulgan before the government introduced tribunal fees. It now costs an employee £1,200 to pursue an Employment Tribunal for redress against unlawful treatment by an employer. GMB is committed to enabling all GMB members whenever they need to get justice against bad employers.”
