GMB Oppose Two Tier Workforce As Surrey NHS Trust Set Up New PLC That Could Lead To Backdoor Privatisation Impacting On 2,500 Staff

New plc could enable transfer of staff who could be forced into the reduced terms and conditions set out in the draft contract of employment for staff at  SABP Care Ltd says GMB

GMB, the union for NHS staff, are planning a campaign against the introduction of a two tier workforce in a new PLC set up by Surrey and Borders Partnership NHS Foundation Trust.

2,500 staff could be transferred to SABP Care Ltd, a new private company set up by the Trust, on terms and conditions inferior to those in the Agenda for Change national agreement. See extract from draft contract of employment for SABP Care Ltd below.

On 9 May 2014 Surrey and Borders Partnership NHS Foundation Trust registered SABP Care Ltd as Private Limited Company with Share Capital. The registered address is 18 Mole Business Park, Randalls Road, Leatherhead, Surrey, KT22 7AD. The company is 100% owned by Surrey & Borders Partnership NHS Foundation Trust. The two directors are Chief Executive Ms Sutherland Edwards and Health Service manager Ms Gaze.  The stated aim of the company is to grow new services and markets. Ms Sutherland Edwards is also listed as a director of Ashley Hill Multi Academy Trust.

The draft contract of employment for SABP Care Ltd states as follows:

“Remuneration and Conditions of Service

Your basic pay is inclusive with no additional supplements for weekend, evening or night working. The rate payable for work undertaken on a Public Holiday will be basic time plus 25%.

Your salary and Terms and Conditions of Service will be in accordance with those determined by the management of SABP Care Limited.

The Organisation reserves the right to alter or amend your terms and conditions, from time to time and will provide you with notification of such changes in writing.”

Paul Maloney, GMB Southern Regional Secretary, said “The Trust board were told that the aim of this wholly owned subsidiary is to achieve success in growing new services and markets. GMB is far from convinced that this is the real aim.

GMB see this as potentially enabling the transfer of 2,500 NHS staff who could be forced into a two tier workforce situation and eventually into a reduced terms and conditions contract of employment.

GMB will vigorously oppose any back door privatisation and we will defend the NHS and employee terms and conditions.”
